Hello!I'm Maelstrom, a self-taught artist & fursuit maker. I am disabled and often quite ill, so please keep this in mind if you reach out to me.Thank you so much for your interest in my page!Please contact me with any questions or concerns you might have.

General

- "MSW" refers to Maelstrom SeaWorks, or Maelstrom Seawing when used in this Terms of Service. MSW refers to both the artist (person) behind the studio & refers to the studio itself as a collective entity.- Clients will be provided with an up-to-date Terms of Service page when work is being discussed. Clients are assumed to have read & agreed to the ToS in full when entering an agreement with MSW. No client is exempt from following the ToS.- Terms of Service may be adjusted at any time, for any reason (for posterity).- All work is bespoke/one-of-a-kind/custom.- While MSW attempts to deliver the best possible quality, human error and small flaws are still to be expected in any finished product. An error is considered acceptable if it does not compromise the overall cohesive appearance, longevity, or function of the finished product.

Usage Rights & Disclaimers

- MSW's work is to be used for non-profit, non-commercial (personal) purposes ONLY.- The works (physical and digital) of MSW may not be reuploaded without permission, resold for profit, copied or traced for personal or monetary gain, or similar.- MSW's work is not permitted for use in any generative AI model training, and is not permitted for use in generative AI prompting, editing, or similar.- MSW prefers not to provide services to individuals who voice extreme, harmful, or excessively exclusionary beliefs/practices. MSW is not responsible for, nor associated with, any harmful or hateful ideologies or actions committed by past/future clients.- MSW is not responsible for ANY misuse of the provided costume or costume supplies.- MSW cannot be held liable for ANY mishap or injury a client may endure while handling or wearing the objects produced. Clients are fully responsible for their own health and well-being. Clients are fully expected to take special care to stay safe while in costume or while working on your personal costume. Any provided care or advice documents given to clients regarding their products/costumes are provided only for instruction on how to preserve a product's longevity & are completely irrelevant to a client's actions and health.- MSW's products and work are not to be reproduced, re-listed, or similar. MSW's photos & products are never to be used in fraudulent or scam advertisements or claimed as one's own work.- Any work produced by MSW (such as, but not limited to: pre-made assets, 3D models) requires credit when used in your own projects, either by referring to Maelstrom SeaWorks, or Maelstrom Seawing. Any completed works should be credited back to MSW as well.- MSW is not responsible for incompatibility of software with commissioned or purchased 3D files. It is expected that buyers or clients are willing to troubleshoot their own 3D modeling or 3D printing software. All files are designed with general workability and compatibility in mind, but it is not guaranteed.

Adjustments & Repairs

- Costumes + costume parts created by MSW are eligible for free repair within 5 years, & free adjustment (for comfort/fit) within 1 month of confirmed delivery date.- This service is ONLY available for light damage and routine wear & tear (popped seams, touch-ups, reapplication of airbrushing or painted details, and similar minor repairs). Unusual, major, or catastrophic damages are not eligible for free repair.- Neither the free adjustment or repair include shipping. Client must completely cover all shipping costs to and from the studio.- Unexpected packages will be returned to sender. Clients are responsible for discussing any needed services & must ensure MSW is made fully aware of any arriving packages.- Adjustment and repair will always be attempted within reason & with good faith. If a repair or adjustment is unable to be completed after inspection of damages, client is still responsible for shipping costs to return the item to them.

Payment

- All transactions/payments will be conducted via PayPal invoices/Goods & Services, without exception. This is for the protection of both the buyer/client & the studio (MSW).- MSW is not obligated to fulfill demands/provide labor or items unless & until the full agreed-upon amount has been paid by client.

Refund & Return Policy

- MSW DOES NOT OFFER REFUNDS, RETURNS, OR REIMBURSEMENTS on services, commission/custom work OR in-stock products.- ALL in-stock items are sold as-is. Buyers are expected to scrutinize item details and photos prior to purchase to ensure they are content with what they will receive. MSW is not responsible for any dissatisfaction caused by lack of familiarity with the listing details or any other available information on the item's condition, appearance, function, etc.- In very rare cases, a partial reimbursement may be possible. The possibility of a partial reimbursement would, in theory, be determined with good faith & only after MSW agrees that a product or service previously agreed upon was impossible to fulfill, inadequate, unacceptable, or otherwise catastrophically unsatisfactory. MSW is not obligated to provide ANY reimbursement is made voluntarily by MSW with the goal of maintaining good standing with clients and the community we serve.

Shipping & Fulfillment

- MSW is not responsible for delays, damages, OR losses caused by a shipping service/courier, or individual parcel carriers.- Shipping costs are unfortunately becoming more and more unpredictable & impossible to calculate far in advance. Due to this growing unpredictability, Shipping costs will no longer be covered in the up-front commission invoice. Clients are expected to fulfill this shipping cost before anything can be sent out.- ALL shipments will be insured based on the total value of the product.- Clients will be provided with a tracking number (or link) after their package has been shipped. Receipt may be provided upon request.- Be aware that bulky, large, or heavy costumes may have expensive shipping costs. For example, gloves/paws by themselves will be relatively affordable to ship. A 'mini partial' (including head, hands, tail) will be much more expensive to ship due to box size and weight.

Turnaround Time

- Each and every product or commission has extremely variable turnaround times (estimated date of completion). Artworks TAT range from 1-6 months on average. Costume/Fursuit TAT range from 6 months to 12 months on average. Commissioned work may be completed within OR outside of these estimated completion dates.- Deadlines are not possible, ever. MSW is not capable of working within deadlines, and any potential client is FULLY responsible for being aware of this before entering an agreement for commissioned work with MSW. Clients who require commissioned work within a deadline are encouraged to seek another studio/artist to complete their desired project.Why is this...?
- Maelstrom SeaWorks is run by a solo artist with multiple debilitating and unpredictable symptoms of disability. Additionally, MSW has several obligations and responsibilities outside of commission work. This circumstance of disability and "IRL" obligations makes it 100% IMPOSSIBLE for MSW to fulfill commission work within a predictable or 'fast' turnaround.

Communcations

- All clients are responsible for voicing any & all questions, concerns, requests, and specifications to MSW regarding commission projects. MSW is not responsible for a client's lack of ability to communicate (we cannot read minds).- Official business-related communication is typically conducted by MSW between 6 PM and 2 AM UTC-8. Clients may expect responses to business-related inquiries within 1 week. Discord (@maelstromseawing) and gmail ([email protected]) are available for clients to contact the studio at any time.- Clients may periodically be contacted with inquiries about their commissioned project's specifications. Commission work is a very involved process & may require multiple 'check-ins' from both the studio and client. Two-way communication is often required for the commission to proceed.
